Purpose

This Privacy Policy describes the types of personal information BrainRobotics ("we", "us" or "our") collects from you when you use our website (www.brainrobotics.com), devices, products, applications, and register for an account with us (collectively, the "Services"), how we may use that information, how we protect the information that you provide us, and to whom and under what circumstances we may disclose it. By using our Services or voluntarily providing personal information to us, you consent to the terms of this Privacy Policy. If you do not agree to the Privacy Policy, please do not use the Services.

Personal Information We Collect

We may collect information that you provide when you interact with us through the Services, including:

i. Information you provide directly to us:

  • Contact details: last name, first name, email address, phone number, login information
  • BrainRobotics prosthetic device diagnostics
  • Business customer contact details: business name, last name and first name of business contact, email address, phone number, business address
  • Clinician information: last name, first name, business address, email address, phone number, credentials, prosthetic facility
  • Clinician information collected from BR University: last name, first name, clinic name, certification number, phone number, certifying body, credentials, country, state, city, preferred language, email address

ii. Information collected automatically:

  • Device data: IP address, MAC address, operating system device-identifying information, type of computer, type of Web browser software, device Bluetooth name, device model, pairing time, if using a trial prosthetic device, app and firmware versions, and the language selection in a device's settings
  • Prosthetic device diagnostics when using the Services
  • Domain name from which you accessed the Services
  • Areas or pages of the Services that you visit
  • Communication interaction data: emails, text messages, and interaction over social media

iii. Information from third parties:

  • Healthcare providers: if you authorize your provider to share medical or fitting information to support your device calibration or care
  • Service providers or vendors: limited technical data where needed for hosting, analytics, or device component support
  • Platforms hosting BR University: data related to certification courses and webinars you view and participate in
  • Research or analytics partners: aggregated, anonymized data used for benchmarking or improving our Services

iv. Information from third-party sources:

  • Social media platforms
  • Other publicly available sources (online information, public records, government agencies, local representatives of BrainRobotics)

Use of Personal Information

We may use information about you for purposes described in this Privacy Policy or disclosed to you through the Services. We may use information about you:

  1. To provide you with the Services
  2. For editorial, feedback, and research purposes to improve the Services
  3. For marketing and promotional purposes, where permitted by law
  4. To create a statistical analysis of user behavior and usage patterns
  5. To review and improve the functionality of the Services
  6. To protect the security or integrity of the Services and our company
  7. To customize the features and layout of the Services
  8. To notify you about updates to the Services
  9. To respond to your inquiries or support requests
  10. To take other actions in response to your use of the Services

BrainRobotics does not sell your personal information under any circumstances.

Disclosure of Personal Information

We may use, process and disclose the information we collect about you for our business purposes and as otherwise described in this Privacy Policy, including:

i. With our affiliates and subsidiaries, for purposes consistent with this Privacy Policy and applicable laws.

ii. With third parties that are under contract with BrainRobotics to perform a service or function on behalf of BrainRobotics. We use outside service providers to facilitate the Services, and to perform functions on our behalf, such as hosting, analytics, support, and maintenance of the Services. These third-party service providers are prohibited from using personal information for any other purpose and are contractually required to comply with all applicable laws and requirements.

iii. With healthcare providers or clinicians, with your authorization, to support device fitting, calibration, or care coordination.

iv. With third parties where you have instructed us or provided us your consent to do so.

v. In order to protect the legal rights, safety, and security of BrainRobotics, our affiliates, business partners, and users of our Services, including to enforce our Terms of Service.

vi. To the extent necessary to comply with applicable law or regulations, governmental and law enforcement requests, court orders, subpoenas and other valid legal process.

Cookies

BrainRobotics does not use cookies when you visit the BrainRobotics website. However, third party platforms may collect cookies. When directed to a third party platform, their cookie policy applies. If BrainRobotics uses cookies in the future, we will update this Privacy Policy and provide users with a method to accept or reject cookies as required by the applicable privacy laws.

Other Sites and Services Operated by Third Parties

The Services may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. When visiting these sites or utilizing online services operated by third parties, the third party's privacy policy would apply, and not BrainRobotics Privacy Policy.

Security

The security and confidentiality of your personal information matters to us. For this reason, BrainRobotics uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, destruction, loss, alteration, or misuse. We evaluate these safeguards on an ongoing basis to help minimize risks. However, no method of transmission or storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security, and you should not expect that your information will be secure in all circumstances.

Retention

We will maintain your personal information for as long as reasonably necessary to comply with legal obligations and applicable laws, or for no longer as required for legitimate business purposes. When personal information is no longer necessary for these purposes, we securely delete or anonymize it.

Account Control

Users have the ability to delete their BrainRobotics Kneuro Mobile App account in the App settings. To delete your BR University account, please contact the Privacy Team at privacyteam@brainrobotics.com.

Do Not Track

Some internet browsers may be configured to send "Do Not Track" ("DNT") signals to the online services that you visit. DNT is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, BrainRobotics and its website do not recognize DNT.

Social Media

We maintain a social media presence, such as a Facebook page, an Instagram page and an X feed. You can interact with us through social media, such as by posting content, sharing material from our Services, and using our social media plug-ins. When you interact with us using social media, we may receive information such as your user ID, your profile picture, photos you post, and similar information, which is often determined by your privacy settings at social media sites. We may use the information for the same types of purposes we describe throughout this Privacy Policy. Your use of social media sites is primarily governed by the site operators' privacy policies and terms of service, and the information you share with us and with others is largely controlled by the privacy settings you have established at those sites.

Cross-Border Transfers

To the extent personal information is transferred out of the country where the owner of that personal information lives, such as to our affiliates or business partners in other countries, including in the United States, different standards may apply to how your data is used and protected in those countries. BrainRobotics has appropriate safeguards in place in accordance with applicable legal requirements to ensure that data is adequately protected irrespective of the country. This includes obtaining written assurances from any third party given access to your data so as to require them to adopt standards that ensure an equivalent level of protection for data as that adopted by BrainRobotics and standardized corporate safeguards and contractual measures (based on the European Commission Model Clauses) for internal data transfers.

GDPR and Other Foreign Privacy Laws

Depending on your jurisdiction outside of the U.S., including the EU and Canada, you may have certain additional rights regarding the collection, use, and/or sharing of your personal information. Accordingly, BrainRobotics provides the utmost protections to your personal information. (See Your Choices and Rights below)

To protect your personal information, we will only make transfers that are necessary for the use of your personal information described in this Privacy Policy and will only transfer your personal information to the extent permitted by applicable data protection laws, relying on existing transfer mechanisms or safeguards, such as standard contractual clauses (SCCs) or explicit consent.

Your Choices and Rights

Depending on your jurisdiction, you may have the following rights:

  1. Access: Request a copy of your personal data
  2. Correction: Request correction of inaccurate data
  3. Deletion: Request deletion of personal data (subject to legal obligations)
  4. Portability: Request transfer of your data to another provider
  5. Opt-out of Sale/Sharing: Opt out of the "sale" or "sharing" of your personal information for targeted advertising
  6. Limit Sensitive Data Use: Restrict our use of sensitive personal data (e.g., health, biometric, or geolocation information)
  7. Lodge a Complaint: Lodge a complaint with your national data protection supervisory authority
  8. Withdraw: Withdraw your consent to BrainRobotics processing of your personal information without incurring any adverse or adverse consequences for you (e.g., you may withdraw your consent to receive marketing communications where consent is the lawful basis for such processing). Please note that in the event of withdrawal of your consent, BrainRobotics may retain aggregated and de-identified data in accordance with your rights and may be required to retain certain personal data in accordance with applicable laws and regulations.

We will acknowledge receipt of your request within ten (10) business days and provide a substantive response within forty-five (45) calendar days or inform you of the reason and extension period (up to a total of ninety (90) days) in writing. We will verify your identity and jurisdiction before processing requests.

Children's Information

Our website and general consumer-facing applications are not directed to children under the age of 13. We do not knowingly collect or solicit personal information from children under the age of 13 on our website without verifiable parental consent. If we learn that a child under the age of 13 has submitted personally identifiable information online without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). If you become aware of any personally identifiable information we have collected from children under 13, please contact us at privacyteam@brainrobotics.com.

Our prosthetic devices and related clinical services may be prescribed for and used by individuals under the age of 18, including children. In these cases, we may collect information necessary for device fitting, calibration, and support. Such information is only collected and processed with the consent of a parent or legal guardian, or as permitted under applicable law (for example, when provided by a clinician in a healthcare setting or when provided by a teacher, school or district who is providing such consent in compliance with applicable law). Parents and guardians may review their child's personal information, request deletion, or withdraw consent by contacting us at privacyteam@brainrobotics.com.

Use by Children Under 13. The Children's Online Privacy Protection Act ("COPPA") requires that all online service providers, including BrainRobotics, obtain parental consent before knowingly collecting personally identifiable information from children under the age of 13. BrainRobotics does not knowingly collect or solicit any personally identifiable information from children under the age of 13 except in compliance with COPPA. Children under the age of 13 are prohibited from using the Services or creating an Account unless they are doing so with parental consent or with the consent of a teacher, school, or district who is providing such consent in compliance with COPPA. If we learn that we have collected personal information from a person under the age of 13 that does not comply with COPPA, we will delete that information in a reasonably prudent amount of time. California & Other U.S. State Consumer Privacy Rights

Under some U.S. state consumer privacy laws, including California (CCPA), Washington (My Health My Data Act) and other U.S. states, residents may have a right to:

  1. Access the categories and specific pieces of personal information BrainRobotics has collected, the categories of sources from which the personal information is collected, the business purpose(s) for collecting the personal information, and the categories of third parties with whom BrainRobotics has shared personal information
  2. Delete personal information under certain circumstances
  3. Correct personal information under certain circumstances
  4. Opt out of the "sale" of personal information or "sharing" of personal information for targeted advertising purposes. We do not sell your personal data in the conventional sense. However, like many companies, we may use advertising and analytics services that are intended to analyze your interactions with our website or app, including for delivering advertising to you. California residents may set the Global Privacy Control (GPC) to opt out of the "sale" or "sharing" of your personal information for each participating browser system that you use. BrainRobotics does not have actual knowledge that it "sells" or "shares" the personal information of consumers under 16 years of age
  5. Appeal a denial of your request. Some states provide additional rights to their residents. If we decline to process your request, you may have the right to appeal our decision. You can do so by replying directly to our denial or emailing privacyteam@brainrobotics.com

BrainRobotics will not discriminate against you for exercising any of these rights, which is further in line with your rights under state laws.

Sensitive Information. BrainRobotics receives information that may be considered sensitive under some state laws, such as certain account Information (e.g., log-in information). We process sensitive personal information to provide our products and services, for product research and development, for authentication, integrity, security, and safety reasons, to communicate with you, for legal reasons, and with your consent. BrainRobotics does not use or disclose sensitive personal information (as defined under CCPA) for purposes of inferring characteristics about a consumer, or in any way that would require us to provide a right to limit under the CCPA. Under certain laws, residents may also be permitted to opt out of certain profiling relating to automated processing analyzing certain categories of an individual's information that would produce a legal or similarly significant effect. BrainRobotics does not engage in this type of profiling of individuals.

These rights are not absolute, are subject to exceptions and limitations, and may not be afforded to residents of all states. In certain cases, we may decline requests to exercise these rights where permitted by law. We will need to verify your identity to process your access, deletion, and correction requests and reserve the right to confirm your state or country residency. To verify your identity, we may require you to log into your existing mobile app account or your BR University account (if applicable), give a declaration as to your identity under penalty of perjury, and/or provide additional information, such as providing at least two pieces of personal information relating to your account (which will be compared to information we have, such as profile information) or as we otherwise may already have in our possession, such as your email address and phone number. We will verify your consumer request by comparing the information you provide to information already in our possession and take additional steps to minimize the risk of fraud. You may designate an authorized agent to submit your verified consumer request by providing written permission and verifying your identity, or through proof of power of attorney.

Updates to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time by posting revisions to our website. If material changes are made in how personal information is collected, used, disclosed or otherwise processed, this Privacy Policy will be updated, and notices will be provided when/where appropriate. Any material changes to this Privacy Policy will be effective at the time of our posting of the updated policy. Where required to do so by law, BrainRobotics may seek your prior consent to any material changes we make to this Privacy Policy.
